Competition (Antitrust) Law

Undistorted and workable competition is essential for sustainable economies. This is why in Turkish Constitution, the State is given the duty to prohibit cartels and the abuse of market power.Turkish Competition Law comprising of regulatory communiques, decisions of the Competition Board andthe court decisions on competition law regulate market behaviour of undertakings. In order to operate within this regulatory framework and in compliance with competition law and with entrepreneurial success, companies need a sophisticated antitrust and competition law strategy.

This strategy should take effect when agreements with competitors are negotiated or when joint ventures are planned or sales and marketing strategies are revised. When setting up distribution and licensing models, such strategy should consider all relevant markets proactively.

It is increasingly important to act prudently with respect to competition law risks, not least due to the globally increasing importance of competition law. Companies may face significant fines, e.g. up to 10% of their turnover; contracts can be declared void and mother companies can be held jointly and severally liable for(former) subsidiaries and joint ventures. In addition, direct or indirect victims of competition law infringements are progressively claiming compensation for cartel damages.
